Following is the format for explicating a SCOTUS case. Write them down in your explication; number them, and then write down your responses. YOU DO NOT NEED TO IDENTIFY CASES THAT ARE PRECEDENTS FOR THE ONE YOU'RE EXPLICATING.
1) State the "facts of the case".
2) Identify the constitutional clause SCOTUS used to justify their decision in the case.
3) Explain the "decision" in the case and how the constitutional clause was used to by SCOTUS to justify the ruling in the case.
4) Explain why the decision in the case is significant.
Homework:
On two separate sheets of paper, explicate the following cases that are explained in the "15 SL Case Summaries;" Each case must be handwritten legibly. Bring both to our next class meeting. Follow the instructions above. The two cases are:
